If you do not agree with these Terms, do not use the website, create an account, place bids, use Buy Now, or submit purchase documents.

Your Account

• You are responsible for protecting your password and session access.
• We may request identity verification or KYC documents before bidding, purchasing, or releasing a vehicle.
• We may suspend or deactivate accounts that violate these Terms, fail to pay invoices, or appear to present fraud or compliance risk.

Bidding Rules

Participation in any auction hosted on High Peak Vehicles Auction LLC constitutes agreement to the auction rules and procedures in effect at the time of bidding.

• Every submitted bid is final and represents a binding offer to purchase the vehicle at the bid amount.
• You may not withdraw a submitted bid simply because you changed your mind.
• If your bid is accepted as the winning offer, you are obligated to complete the purchase according to the invoice and document instructions.
• Buy Now, where shown, may end the listing immediately once the purchase action is confirmed.
• We may reject, cancel, or review activity that appears fraudulent, abusive, automated, or inconsistent with fair auction participation.

Payment Obligations

After a winning bid or confirmed purchase, the buyer receives invoice and payment instructions through the account dashboard or official communication from our office.

• Payment must be completed within the timeframe shown on the invoice or purchase instructions.
• Payment is completed only through approved payment methods shown on the official invoice.
• Failure to complete payment may result in penalties, account restrictions, cancellation of access, or additional recovery actions where permitted.
• Buyer is responsible for reviewing the final price, delivery fee, documentation fee, taxes, and other listed charges before payment.

High Peak Vehicles Auction LLC does not request payment by gift cards, cryptocurrency, anonymous transfers, or unofficial payment channels.

Title, Documents, Pickup, and Risk

Vehicle release, title paperwork, purchase agreements, and pickup or delivery details are handled after the purchase file is reviewed and payment is confirmed.

• Title or ownership documents are prepared according to the transaction file and buyer details.
• Buyer must review and sign required purchase documents where applicable.
• Pickup or delivery timing may depend on vehicle location, document status, payment confirmation, and carrier availability.
• Risk of loss, storage terms, release timing, and delivery responsibility may be defined by the listing, invoice, or purchase agreement.

Vehicle Condition and As-Is Sale

Vehicle information, photographs, descriptions, mileage, equipment, title notes, and condition details are provided to the extent available. Buyers are responsible for reviewing each listing carefully before bidding or buying.

Unless a written listing term, warranty document, or purchase document states otherwise, vehicles may be sold AS-IS / WHERE-IS with all faults and without warranties regarding condition, merchantability, fitness for a particular purpose, mileage, history, prior use, or future performance.

Prohibited Conduct

You agree not to misuse the website or auction process.

• Do not place bids without the financial ability or intent to complete the purchase.
• Do not coordinate with other users to manipulate or suppress bidding.
• Do not use bots, scrapers, automated tools, or unauthorized scripts.
• Do not attempt to bypass authentication, rate limits, security controls, or account restrictions.
• Do not submit false identity, address, payment, or document information.
• Do not use the platform for illegal activity, fraud, money laundering, or abusive conduct.

Limitation of Liability

To the maximum extent permitted by law, High Peak Vehicles Auction LLC is not liable for indirect, incidental, special, consequential, punitive, lost-profit, or loss-of-opportunity damages arising from use of the website, auction participation, vehicle condition, shipping delays, third-party services, or unavailable website functionality.

Website content is provided for informational and transactional purposes. We do not guarantee uninterrupted operation, error-free listings, or that every displayed detail is free from omissions or inaccuracies.

Governing Law and Disputes

These Terms and any disputes arising from website use, bidding activity, invoices, purchase documents, or auction participation shall be governed and interpreted in accordance with applicable laws of the United States, without regard to conflict of law principles.

Buyers should contact our office promptly regarding any invoice, document, payment, pickup, delivery, or listing concern so the matter can be reviewed through the appropriate support channel.

Changes to These Terms
